Motion by the respondent Children's Place Retail Stores, Inc., to dismiss an appeal from a judgment of the Supreme Court, Kings County, dated December 5, 2008, insofar as asserted against it on the ground that the appeal was untimely taken.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted and the appeal is dismissed as against the respondent Children's Place Retail Stores, Inc., without costs or disbursements.
