DECISION & ORDER ON MOTION

Motion by the appellant for leave to reargue that branch of his prior motion which was for a preference in the calendaring of an appeal from a judgment of the Supreme Court, Nassau County, dated May 6, 2008, which was determined by decision and order on motion of this court dated September 29, 2008.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and upon reargument, so much of the decision and order on motion dated September 29, 2008, as denied that branch of the appellant's prior motion which was for a preference in the calendaring of the appeal is recalled and vacated, that branch of the prior motion is granted, and the appeal will be calendared expeditiously.
