Application by the appellants on an appeal from an order of the Supreme Court, Suffolk County, dated June 6, 2008, to substitute Janice W. Mosley, administratrix of the estate of
James Wallace, for the deceased defendant James Wallace.
Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is
ORDERED that the application is granted and Janice W. Mosley, administratrix of the estate of James Wallace, is substituted for the deceased defendant James Wallace, and the caption has been amended accordingly; and it is further,
ORDERED that the appellants time to serve and file reply briefs is enlarged until June 9, 2009, and the reply briefs, if any, shall be served and filed on or before that date.
