Appeal by Laurence Toole and the Town of Ramapo Democratic Committee, by permission, from an order of the Supreme Court, Rockland County, dated September 24, 2008. The appeal has not been perfected and the appellants have not sought an enlargement of time to perfect.
Now, on the court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements (see 22 NYCRR 670.8[e]); and it is further,
ORDERED that the stay granted by decision and order on motion dated October 15, 2008, is vacated forthwith.
