CISION & ORDER ON MOTION

Motion by the respondent for reinstatement as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on February 2, 1981. By decision and order on motion of this court dated January 27, 1998, he was suspended from the practice of law pursuant to 22 NYCRR 691.4(l)(1)(iii), upon a finding that he was guilty of professional misconduct immediately threatening the public interest based on uncontroverted evidence of such professional misconduct, and the issues raised were referred to the Honorable Theodore Kupferman, as Special Referee to hear and report. By opinion and order of this court dated July 10, 2000, the respondent was disbarred, effective immediately. By decision and order on motion of this Court dated July 2, 2008, the respondent's motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on the respondent's current fitness to practice law.

Upon the papers submitted to the court, it is

ORDERED that the motion is denied.

We find that the respondent does not demonstrate the requisite fitness and character to practice law.
