Now, upon reading and filing the affidavit of Emily A. Vella, Esq., sworn to April 20, 2009, the notice of motion with proof of service thereof, the affirmation of William D. Broderick, Jr., Esq., dated April 22, 2009, and due deliberation having been had thereon,
