Petitioner-appellant having moved to vacate the dismissal of the appeal taken herein from an order of the Family Court, Onondaga County, entered in the Office of the Clerk of said Court on August 1, 2008, and respondent-respondent having cross-moved to dismiss the appeal,
Now, upon reading and filing the affidavits of Shari R. Cohen, Esq., sworn to April 24, 2009 and May 5, 2009, the notice of motion with proof of service thereof, the affidavit of Susan B. Janowski, Esq., sworn to May 7, 2009, the notice of cross-motion with proof of service thereof, the statement of Shari R. Cohen, Esq., dated May 11, 2009, the affidavit of Susan B. Janowski, Esq., sworn to May 13, 2009, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted and petitioner-appellant shall file the original and ten copies of the stipulated or settled record and ten briefs on the appeal, together with proof of service, on or before June 17, 2009, and in the event of failure to so perfect the appeal is hereby dismissed without further order, and
It is further ORDERED that the cross-motion is dismissed.
