DECISION & ORDER ON MOTION

Motion by the appellant to consolidate appeals from a judgment of the Supreme Court, Suffolk County, dated June 11, 2008, and two orders of the same court dated June 12, 2008, and June 25, 2008, respectively, to enlarge the time to perfect the appeals, and to deem the notice of appeal from the order dated June 25, 2008, to be a premature notice of appeal from a judgment of the same court dated November 6, 2008.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the branch of the motion which is to deem the notice of appeal from the order dated June 25, 2008 (Appellate Division Docket No. 2008-10393), to be a premature notice of appeal from the judgment dated November 6, 2008, is granted; and it is further,

ORDERED that the branch of the motion which is to consolidate the appeals is granted, and the parties shall file 10 copies of the record on appeal or appendix and their respective briefs; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeals is granted, the appellant's time to perfect the appeals is enlarged until July 27, 2009, and the record or appendix on the appeals and the appellant's brief must be served and filed on or before that date.
