ORDERED that the decision and order on application of this court dated May 14, 2009, which denied an application by the defendant, pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this court from an order of the County Court, Suffolk County, dated December 23, 2008, is amended by deleting from the preamble thereof the date "December 23, 2006," and substituting therefor the date "December 23, 2008".
