DECISION & ORDER ON MOTION

Motion by the respondent for leave to appeal to the Court of Appeals from an opinion and order of this court dated December 30, 2008. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on December 11, 2002. By decision and order on motion of this court dated November 7, 2007, the respondent was suspended from the practice of law, pursuant to 22 NYCRR 691.4(l)(10(ii) and (iii), the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts was authorized to institute and prosecute a disciplinary proceeding against the respondent, and the Honorable Jerome M. Becker was appointed as Special Referee to hear and report on the issues raised. By decision and order on motion of this court dated March 27, 2008, those branches of the respondent's motion which were to stay the disciplinary hearing and disqualify a witness from testifying were denied as academic and that branch of his motion which was for summary judgment was denied. By opinion and order of this court dated December 30, 2008, this court disbarred the respondent based on the Special Referee 's report which sustained both charges of professional misconduct against him.

Upon the papers submitted in support of the motion and the papers submitted in opposition thereto, it is

ORDERED that the motion is denied.
