It is Ordered that the motion to re-instate the stay is denied without prejudice to renew with proof of either the deposit with Civil Court or payment to the landlord of the April, May and June 2009 use and occupancy, at the rate of $1,162- per month. The Court notes that the appeal has yet to be perfected.
