DECISION & ORDER ON MOTION

Motion by Mark P. Isaacs for leave to appeal to this court from an order of the Supreme Court, Nassau County, entered April 22, 2008, and, inter alia, to stay enforcement of the order and for a downward modification of his pendente lite support obligation, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary or the order is appealable as of right (see CPLR 5701); and it is further,

ORDERED that the motion is otherwise denied.
