Appellant having moved for an extension of time to perfect the appeal taken herein from an order of the Family Court, Erie County, entered in the Office of the Clerk of said Court on January 7, 2009, and for an extension of the stay granted by order of the Honorable Eugene M. Fahey, dated January 22, 2009, and previously extended by order of this Court entered March 31, 2009,
Now, upon reading and filing the affirmation of Charles D. Halvorsen, Esq., dated May 19, 2009, the notice of motion with proof of service thereof, the affidavit of Thomas R. Lochner, Esq., sworn to May 27, 2009, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is in all respects granted on condition that the appeal is perfected on or before July 27, 2009, and, if so perfected, the appeal shall be placed on the calendar for the term of Court commencing September 8, 2009.
