Eng, Elaine v Rosado, Oswaldo, et al.
It is Ordered that the motion for a stay of the Housing Part proceeding is granted on the condition that the landlord-appellant: 1- perfects the appeal by the September 2009 term - the filing deadline is July 7, 2009; and 2- installs carpeting, on a temporary basis, in the private hallway, foyer and living room and repairs the kitchen floor. In the event of the landlord-appellant's failure to comply with the foregoing conditions by July 7, 2009, the tenants-respondents may move on five days' notice for an order vacating the stay of the H P proceeding. Tenants are to provide access for the carpet installation and for the repair of the kitchen floor.
