| DECISION & ORDER ON MOTION |
Appeal by the defendants from an order of the Supreme Court, Queens County, dated March 16, 2009. The attorney for the plaintiffs-respondents was disbarred effective May 19, 2009 (see CPLR 321[c].
Now, on the court's own motion, it is
ORDERED that within 10 days from the date of this decision and order on motion the attorney for the defendants-appellants is directed to serve a copy thereof upon the plaintiffs-respondents pursuant to CPLR 2103(b)(1) or (2), and (c), and to file proof of such service in the office of the Clerk of this court, within five days thereafter, which service shall constitute notice to the plaintiffs-respondents to appoint a new attorney pursuant to CPLR 321(c); and it is further,
ORDERED that within 30 days after service upon them of a copy of this decision and order on motion, the respondents shall appoint a new attorney and advise the court and the appellants' counsel of that attorney's name and address, or shall, if authorized by law, elect to appear pro se.
We note that the respondent Jorge R. Valdez may appear pro se but the corporate respondent Erik E. Russo, Inc., must appear by an attorney (see CPLR 1201; 321[a]).
