Appellant having moved to proceed pro se on the appeals taken from the judgments of the Livingston County Court, rendered January 9, 2007, and October 23, 2007 and for other relief,
Now, upon reading and filing the affidavit of Carl Goossens sworn to May 12, 2009, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be, and the same hereby is, granted to the extent that the orders of this Court entered January 10, 2008 and September 4, 2008 are vacated, and appellant may prosecute his appeals as a poor person pro se, and
It is further ORDERED that the appeals herein may be prosecuted upon the original papers and ten briefs, handwritten, typewritten or reproduced pursuant to CPLR 5529, and
It is further ORDERED that the Clerk of the County of Livingston is hereby directed to provide Carl Goossens with copies of all papers and transcripts of stenographic or audio taped minutes, if any, of the proceedings upon which the appeals are based and,
It is further ORDERED that appellant shall file such papers and transcripts in the Office of the Clerk of this Court at the time he files his briefs, together with proof of service of one copy of the brief on the District Attorney and this appeal will not be placed on the court calendar until such time as the transcripts and briefs are so filed.
It is further ORDERED that the motion is otherwise denied.
