DECISION & ORDER ON MOTION

Motion by the appellant to strike the briefs of the respondent and the attorney for the children on an appeal from an order of the Family Court, Kings County, dated October 3, 2008, on the ground that the briefs refer to matter dehors the record and to preclude the respondent and the attorney for the children from participating in oral argument.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the motion is denied.
