Application by the appellant-respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal and cross-appeal from an order of the Supreme Court, Kings County, dated November 21, 2008.
ORDERED that the cross appeal is dismissed, without costs or disbursements, as the order on appeal did not determine the respondents-appellants' motion which remains pending and undecided before the Supreme Court, Kings County (see Katz v Katz, 68 AD2d 536); and it is further,
ORDERED that the application is granted; and it is further,
ORDERED that the appellant-respondent's time to perfect the appeal is enlarged until August 18, 2009, and the record or appendix on the appeal and the appellant-respondent's brief must be served and filed on or before that date.
