DECISION & ORDER ON MOTION

Appeal by Berta B. from an order of fact-finding and disposition of the Family Court, Westchester County, dated December 4, 2007, which was determined by decision and order of this court dated March 31, 2009. By decision and order on certification dated February 22, 2008, the appellant was granted leave to prosecute the appeal as a poor person and Althea F. Richardson was assigned as counsel on the appeal.

Now, on the court's own motion, it is

ORDERED that Neal D. Futerfas, Esq., 50 Main Street, Suite 1000, White Plains, New York, 10606, is assigned, nunc pro tunc, as of August 7, 2008, as of counsel to Althea F. Richardson to represent the appellant in the above-entitled appeal.
