It is Ordered that the application, pursuant to CPLR § 5704(b), is granted to the extent of striking the stay imposed by Civil Court's order to show cause signed on June 23, 2009 and returnable on June 30, 2009. The Marshal may execute forthwith upon the warrant of eviction after personal service of a copy of this order and filing proof thereof with the Clerk of the Civil Court-New York County.
