DECISION & ORDER ON MOTION

Motion by the appellant to hold in abeyance an appeal from a judgment of the Supreme Court, Kings County, rendered September 5, 1995, pending determination of his motion pursuant to CPL 440.10 and 440.20, by the Supreme Court, Kings County.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the appellant shall notify the court by letter once his motion pursuant to CPL 440.10 and 440.20 is decided.
