It is Ordered that the motion for an order granting a certificate for leave to appeal to the Appellate Term-First Department from the September 17, 2008 of the Criminal Court is GRANTED. Within fifteen (15) days of the issuance of this order, a copy of this order is to be served on the District Attorney-New York County, along with a Notice of Appeal, and proof thereof is to be filed, in duplicate, with the Appeals Clerk of the Criminal Court.
