It is Ordered that the motion and cross-motion are consolidated for disposition. The stay of the execution of the warrant of eviction is continued through August 27, 2009, to afford the appellant a further opportunity to perfect the appeal. In the event that respondent-appellant fails to comply with the orders of this court, the petitioner-respondent may move on five days' notice for an order dismissing the appeal and vacating the stay.
