ORDERED that its decision and order on motion dated May 18, 2009, in the above-entitled appeal, which determined a motion by the nonparty-appellant, on an appeal from an order of the Supreme Court, Nassau County, dated August 12, 2008, is amended by deleting from the second decretal paragraph thereof the date "June 17, 2009," and substituting therefor the date "August 3, 2009."
