Separate motions by the respondents 2001 Marcus Ave, LLC, Bldg 1031, LLC, and Jeffrey Management Corp., the respondents SMC Realty, Ltd., and Somerset Investors Corp., d/b/a Somerset Mortgage Bankers, and the respondent L.A.S. Construction & Services, Inc., for leave to reargue an appeal from an order of the Supreme Court, Nassau County, dated August 20, 2007, which was determined by decision and order of this court dated March 31, 2009.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motion of the respondents 2001 Marcus Ave, LLC, Bldg 1031, LLC, and Jeffrey Management Corp., and the motion of the respondent L.A.S. Construction & Services, Inc., are denied; and it is further,
ORDERED that the motion of the respondents SMC Realty, Ltd., and Somerset Investors Corp., d/b/a Somerset Mortgage Bankers, is denied without prejudice to seeking relief in the Supreme Court, Nassau County.
