Motion by the appellant for leave to reargue an appeal from an order of the Supreme Court, Kings County, dated September 18, 2007, which was determined by decision and order of this court dated April 21, 2009, and to waive the motion filing fee.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,
ORDERED that the branch of the motion which is for leave to reargue is denied.
