On the court's own motion, it is
ORDERED that its decision and order on motion dated June 29, 2009, in the above-entitled matter, which granted a motion by the appellant, on an appeal from a judgment of the Supreme Court, Kings County, rendered September 5, 1995, is amended by deleting from the second paragraph the words "no papers having been filed in opposition or relation thereto" and substituting therefor the words "the papers filed in opposition thereto."
