Appellant having moved for a writ of error coram nobis vacating the order of this Court, entered July 12, 1996, which dismissed the appeal taken from a judgment of the Monroe County Court rendered February 7, 1994, on the ground that appellant failed to perfect timely the appeal.
Now, upon reading and filing the affidavit of Malik Black sworn to March 30, 2009, the notice of motion with proof of service thereof, the affirmation of Kelly Christine Wolford dated May 21, 2009, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be and the same hereby is denied.
