It is Ordered that the tenant-respondent's motion to vacate the stay of the attorney's fees hearing and to dismiss the appeal is granted unless the appeal is perfected by September 9, 2009 and noticed for the November 2009 term. In the event the landlord-appellant fails to perfect her appeal by September 9, 2009, the respondent may move on five days' notice for an order vacating the stay and dismissing the landlord's appeal. The papers submitted as a cross-motion were considered solely in opposition to the motion [ CPLR § 2215 ]. The appellant is referred to CPLR § 5525(d) regarding the reconstruction of the missing portions of the transcript.
