Roxborough Apts. Corp. v Westreich, Larry
It is Ordered that the motion and cross-motion are consolidated for disposition. The execution of the warrant of eviction is stayed through July 15, 2009. This is to afford the appellant a final opportunity to tender the accruing use and occupancy for June and July 2009, to the petitioner, by certified check, by no later than July 15, 2009 at 11:00 am. In the event the tender is made, the appellant must move for a continuation of the stay of the execution of the warrant of eviction beyond July 15, 2009. Otherwise, the warrant may be enforced after said date. In all other respects, the motion and cross-motion are denied, without prejudice.
