It is Ordered that the motion to dismiss the appeal of the November 21, 2009 order of the New York County Civil Court is granted, pursuant to 22 NYCRR § 640.6. The Court notes that plaintiff's appeal from the judgment after trial of the Civil Court, entered March 6, 2008, in favor of the defendant dismissing the complaint, was affirmed by this Court on May 5, 2009.
