| DECISION & ORDER ON MOTION |
Motion by the respondent Lynda Byrd to dismiss a proceeding pursuant to CPLR article 78 which was transferred to this court by order of the Supreme Court, Suffolk County, dated December 3, 2008, for failure to prosecute. Cross motion by the petitioner to enlarge the time to perfect the proceeding.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied, and it is further,
ORDERED that the cross motion is granted, the petitioner's time to perfect the proceeding is enlarged until August 3, 2009, and the petitioner's record or appendix and brief must be served and filed on or before that date; and it is further,
ORDERED that no further enlargement of time shall be granted.
