Motion by the respondent for leave to reargue an appeal from an order of the Family Court, Queens County, dated April 15, 2008, which was determined by decision and order of this court dated March 10, 2009, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court. Separate motions by Gerard W. Wallace and by MFY Legal Services, Inc., for leave to file papers as amici curiae in support of the motion.
