DECISION & ORDER ON APPLICATION

Application by Robert Katulak, as executor of the estate of John Katulak, to substitute Robert Katulak, as executor of the estate of John Katulak, for the decedent John Katulak on appeals from three orders of the Supreme Court, Orange County, all dated January 7, 2008.

Upon the papers filed in support of the application and upon the stipulation of the parties, it is

ORDERED that the application is granted and Robert Katulak, as executor of the estate of John Katulak, is substituted for the decedent John Katulak, and the caption is amended accordingly.
