ORDERED that the order on application of this court dated June 23, 2009, which granted an application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from an order of the Supreme Court, Westchester County, dated September 30, 2008, is amended by deleting from the preamble thereof the words "Kings County," and substituting therefor the words "Westchester County".
