| DECISION & ORDER ON MOTION |
Motion by the appellant pro se to relieve counsel assigned to prosecute an appeal from a judgment of the County Court, Westchester County, rendered September 10, 2008, and for the assignment of new counsel, or for leave to serve and file a supplemental brief.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the branch of the motion which is to relieve counsel assigned to prosecute the appeal from the judgment rendered September 10, 2008, and for the assignment of new counsel is denied; and it is further,
ORDERED that the branch of the motion which is for leave to serve and file a supplemental brief is denied as academic in light of the decision and order on motion of this court dated June 29, 2009.
