PRESENT : PESCE, P.J., GOLIA and RIOS, JJ.

NO. 2008-40 K C
NEILAN STERN,

Appellant,

-against-

LAURENCE LEVINE,

Respondent.

DECISION Motion by tenant-respondent for leave to appeal to the Appellate Division and for incidental relief denied.

It is noted that tenant's claim that he has become 62 years old since this appeal was decided and that landlord is therefore required to offer him alternative accommodations should be addressed in the first instance to the Civil Court.
