ORDER ON CERTIFICATION Assignment of Counsel

Appeal by the attorney for the children Jesse M., Sapphire M., and Shawn M. from an order of the Family Court, Kings County, dated July 1, 2009. Pursuant to Family Court Act §§ 1118 and 1120, and upon the certification of Richard D. Katz, Esq., dated July 16, 2009, it is

ORDERED that the nonparty-respondent Joseph M. is granted leave to proceed as a poor person on the appeal, and the following named attorney is assigned as counsel to respond to the appeal on behalf of nonparty-respondent Joseph M.:

(1) nonparty-respondent Joseph M. is interested in responding to the appeal, or

(2) nonparty-respondent Joseph M. is not interested in responding to the appeal, or that he has been unable to contact nonparty-respondent Joseph M., and wishes to be relieved of the assignment.
