ORDERED that its decision and order on motion dated June 30, 2009, in the above-entitled appeal, amending a prior decision and order on motion dated May 18, 2009, which determined a motion by the nonparty-appellant, on an appeal from an order of the Supreme Court, Nassau County, dated August 12, 2008, is amended by deleting therefrom the date "June 17, 2009," and substituting therefor the date "September 4, 2009."
