DECISION & ORDER ON MOTION

Motion by Terry Peterson for leave to appeal to this court from an order of the Family Court, Suffolk County, dated July 10, 2009, and to stay a hearing on the respondent's petition in the above-entitled proceeding pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the hearing on the respondent's petition in the above-entitled proceeding is stayed pending hearing and determination of the appeal.
