Motion by the appellant-respondent for leave to appeal to the Court of Appeals from a decision and order of this court dated May 5, 2009, which determined an appeal and cross appeal from an order of the Supreme Court, Nassau County, entered January 17, 2008. Separate motion by the appellant-respondent for leave to reargue the appeal.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motions are denied, with one bill of $100 costs.
