DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, pursuant to CPL 460.30 for an extension of time to take an appeal from a judgment of the County Court, Suffolk County, rendered May 4, 2009.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the branch of the motion which is pursuant to CPL 460.30 to extend the time to take the appeal is granted, and the notice of appeal filed June 16, 2009, is deemed timely filed; and it is further,

ORDERED that the motion is otherwise denied as academic.
