Ordered that the motion is granted to the extent of granting defendant permission to file an untimely notice of appeal. The Criminal Court Appeal's Clerk is directed to file a notice of appeal on behalf of the defendant. That branch of the motion seeking leave to appeal as a poor person is denied without prejudice to renew upon a more complete affidavit pursuant to CPLR 1101. The Clerk's Office is directed to mail a copy of this order, and a pro-se poor person application form, to the defendant.
