DECISION & ORDER ON MOTION

On the court's own motion, it is

ORDERED that its order to show cause dated August 6, 2009, in the above-entitled matter, which held in abeyance a motion by the appellant pro se for leave to prosecute an appeal from a judgment of the Supreme Court, Nassau County, rendered April 27, 2007, as a poor person, and for the assignment of counsel, is amended by deleting from the first paragraph the words "County Court", and substituting therefor the words " Supreme Court".
