Motion by the appellant to stay enforcement of an order of the Supreme Court, Kings County, dated April 14, 2009, pending hearing and determination of an appeal therefrom, and to waive the filing fee for making the motion.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,
ORDERED that the branch of the motion which is to stay enforcement of the order dated April 14, 2009, is denied.
