DECISION & ORDER ON MOTION

Motion by the petitioner-respondent to dismiss an appeal from an order of the Family Court, Kings County, dated May 5, 2009, or for poor person relief and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to dismiss the appeal is denied; and it is further,

ORDERED that the branch of the motion which is for poor person relief and for the assignment of counsel is granted; and it is further,

ORDERED pursuant to Family Court Act § 1120 the following named attorney is assigned as counsel for the petitioner-respondent to defend the appeal:
