| DECISION & ORDER ON MOTION |
Appeal by James F. from an order of the Family Court, Suffolk County, dated April 2, 2009. By order to show cause dated July 20, 2009, the parties or their attorneys were directed to
show cause before this court why an order should or should not be made and entered relieving the assigned counsel for the appellant and dismissing the appeal in the above-entitled proceeding, on the ground that assigned counsel had not been able to contact the appellant.
Upon the court's own motion and the papers filed in response thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that assigned counsel's time to comply with the order on certification dated June 9, 2009, by determining if the appellant is interested in pursuing the appeal is enlarged until September 11, 2009, and assigned counsel shall attempt to contact the appellant at the address provided to her by the attorney for the child.
