DECISION & ORDER ON MOTION

Separate motions by the respondent and the attorney for the child to dismiss an appeal from an order of the Family Court, Kings County, dated December 3, 2008, on the ground that the appeal has been rendered academic.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and the appeal is dismissed, without costs or disbursements (see Matter of Mary Ellen C. v Joseph William C., 79 AD2d 1024).
