Application by the respondent on an appeal from an order of the Supreme Court, Westchester County, dated September 8, 2004, to substitute Ethel S. Lipman, executor of the estate
of Harry Lipman, for the deceased defendant Harry Lipman.
Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is
ORDERED that the application is granted and Ethel S. Lipman, executor of the estate of Harry Lipman, is substituted for the deceased defendant Harry Lipman, and the caption has been amended accordingly.
