Motion by the respondents for leave to reargue appeals from an amended order of the Supreme Court, Richmond County, dated March 11, 2008, and an order of the same court dated May 19, 2008, which were determined by decision and order of this court dated May 5, 2009, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this court.
